Yesterday, Congressman Scott Tipton (R-CO) and Senators Michael Bennet (D-CO) and Cory Gardner (R-CO) sent Secretary of the Interior Sally Jewell a follow-up letter expressing disappointment with the Interior Department’s decision not to appeal a federal judge’s decision regarding ColoWyo Coal Mine, underscoring “The executive branch has a duty to defend its permitting actions.” The judge gave the Office of Surface Mining 120 days to file a new Environmental Assessment of the South Taylor Pit, saying the first one was insufficient. Due to the short time frame, the lawmakers urged Jewell in May to take all necessary and appropriate action, including consideration of an appeal, to prevent the impending closure of the Colowyo mine and loss of hundreds of jobs in Moffat County. The court-ordered deadline for OSM to prepare a new analysis is September 6th. Tipton, Bennet and Gardner are asking Jewell to give assurances Interior will meet the deadline or request an extension.
