Driver Suspected Of Causing Head-On Was Sober

Police have determined Felix Cervantes, the driver suspected of causing the fatal accident on Rabbit Ears Pass earlier this week, was not intoxicated at the time of the incident. The head-on resulted in injuries to the other driver, 42-year-old Lienchai Harker, and  the death of her passenger, 24-year-old James Fagan, both of Breckenridge. A State Patrol representative confirmed this morning that toxicology tests showed Cervantes, who was also injured in the incident, was not under the influence. Charges against Cervantes are still pending the results of the investigation.
